Welcome to Port A Vacation Company ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website at portavacation.co and all services we provide, including vacation rental bookings, vehicle rentals, activity reservations, and related services in Port Aransas, Texas. By accessing our website or making a booking, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement to use our services. Vacation home rentals require a minimum age of 22. Jeep rentals require a minimum age of 25. By making a booking, you represent that all information you provide is accurate and complete, and that you are authorized to use the payment method provided.

2. Bookings & Reservations

Vacation Home Rentals

• All vacation home bookings are subject to availability and confirmation by our team.
• Check-in and check-out times are specified in your booking confirmation. Early check-in or late check-out is not guaranteed and may incur additional fees.
• Maximum occupancy limits must be respected. Exceeding the stated guest count may result in immediate termination of your stay without refund.
• You are responsible for leaving the property in a reasonable condition. Excessive cleaning, damage, or missing items may result in charges to your payment method on file.

Vehicle Rentals

• Vehicle rentals (including golf carts, e-bikes, and other vehicles) are subject to availability and require a signed rental waiver before use.
• Renters must be at least 18 years of age (25 for jeeps) and hold a valid driver's license where applicable.
• Vehicles must be operated in accordance with all local, state, and federal laws. You are responsible for any traffic violations, fines, or legal consequences incurred during your rental period.
• You are financially responsible for any damage to, loss of, or theft of the rented vehicle during your rental period, including damage caused by negligence or misuse.
• Vehicles are delivered to and picked up from your specified address. Delivery and pickup are included in the rental price unless otherwise stated.

Activity Reservations

• Activity reservations are subject to availability, weather conditions, and minimum participant requirements.
• Certain activities may require signed liability waivers prior to participation.
• We reserve the right to cancel or reschedule activities due to unsafe weather conditions or other circumstances beyond our control.

3. Pricing & Payment

• All prices are listed in U.S. dollars and are subject to applicable taxes, fees, and surcharges.
• Nightly rates for vacation homes are dynamic and may vary based on season, demand, and length of stay.
• Full payment is required at the time of booking unless otherwise specified. Payments are processed securely through Stripe.
• By providing your payment information, you authorize us to charge the total booking amount, including any applicable taxes, cleaning fees, and service fees.
• Pricing errors do not obligate us to honor an incorrect rate. If a pricing error is identified, we will notify you and offer the option to proceed at the correct price or cancel for a full refund.

4. Cancellation & Refund Policy

Vacation Home Rentals

• Within 48 hours of booking (check-in 14+ days away): Free cancellation, full refund.
• After the 48-hour window or check-in less than 14 days away: Non-refundable.
• No-shows and early departures are non-refundable.

Vehicle Rentals

• 48+ hours before rental start: Full refund minus a processing fee.
• Less than 48 hours before rental start: No refund.
• Early returns are non-refundable.

Activities

• 48+ hours before activity: Full refund minus a processing fee.
• Less than 48 hours: No refund.
• If we cancel an activity due to weather or other circumstances beyond our control, you will receive a full refund or the option to reschedule.

All cancellation requests must be submitted in writing to info@portavacation.co. Refunds are processed within 5–10 business days to the original payment method.

5. Property Rules & Guest Conduct

By staying at any of our vacation rental properties, you agree to:

• Comply with all house rules provided in your booking confirmation and posted at the property.
• Respect quiet hours as established by the property and local ordinances.
• Not use the property for any unlawful purpose, commercial activity, or event (including parties and gatherings exceeding the stated occupancy) without prior written approval.
• Not smoke inside any rental property. Smoking violations will result in a minimum $250 cleaning fee.
• Notify us immediately of any damage, maintenance issues, or safety concerns during your stay.
• Comply with all City of Port Aransas short-term rental regulations.

We reserve the right to terminate your stay without refund if you violate these rules or engage in conduct that is disruptive, dangerous, or damaging to the property or neighboring properties.

6. Liability & Waivers

Assumption of Risk: Participation in activities and use of rental vehicles (including golf carts and e-bikes) involve inherent risks. You acknowledge and voluntarily assume all risks associated with these activities.

Waiver Requirement: Certain services require a signed liability waiver before use. Failure to sign the required waiver may result in cancellation of your reservation without refund.

Limitation of Liability: To the maximum extent permitted by law, Port A Vacation Company, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to personal injury, property damage, or loss of enjoyment.

Property Damage: You agree to pay for any damage to rental properties or vehicles caused by you or members of your party. We reserve the right to charge the payment method on file for damages.

7. Intellectual Property

All content on our website, including text, images, logos, graphics, and software, is the property of Port A Vacation Company or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

8. Third-Party Links & Services

Our website may contain links to third-party websites or services, including but not limited to Airbnb, Stripe, and activity providers. We are not responsible for the content, privacy practices, or terms of service of any third-party websites. Your use of third-party services is governed by their respective terms and policies.

9. SMS/Text Messaging Terms

By providing your phone number and opting in to receive text messages from Port A Vacation Company, you agree to the following terms regarding our SMS/text messaging program:

Program Description

Port A Vacation Company may send you text messages related to your bookings, including but not limited to: booking confirmations, check-in and check-out instructions, property access codes, payment reminders, one-time verification codes, guest satisfaction surveys, and promotional offers for returning guests.

Consent

By providing your phone number during the booking process on portavacation.co or by texting START to (361) 247-0427, you expressly consent to receive transactional and marketing text messages from Port A Vacation Company. Consent is not a condition of purchase. You may opt in to receive messages at any time by texting START or SUBSCRIBE to (361) 247-0427.

Message Frequency

Message frequency varies based on your booking activity. Transactional messages (booking confirmations, access codes, check-in instructions) are sent as needed in connection with your reservation. Promotional messages are sent no more than four (4) times per month.

Message and Data Rates

Message and data rates may apply. Check with your wireless carrier for details about your messaging plan. Port A Vacation Company is not responsible for any fees charged by your carrier.

Opt-Out Instructions

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message. Opting out of marketing messages will not affect transactional messages related to an active booking.

Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier.

Supported Carriers

Our text messaging program is compatible with most major U.S. carriers, including AT&T, T-Mobile, Verizon, and others. Service may not be available on all carriers or in all areas.

10. Analytics, Tracking & Advertising Technologies

Our website uses third-party analytics and advertising technologies to improve our services, understand how visitors interact with our site, and deliver relevant advertising. By using our website, you acknowledge and agree to the use of these technologies as described below and in our Privacy Policy.

Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC, to collect information about how visitors use our website. Google Analytics uses cookies and similar technologies to track and report on website traffic, page views, user behavior, and demographic information. This data is aggregated and anonymized where possible. You can opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on.

Meta (Facebook) Pixel

We use the Meta Pixel (formerly Facebook Pixel), a tracking technology provided by Meta Platforms, Inc., to measure the effectiveness of our advertising campaigns on Facebook and Instagram, deliver targeted advertisements to users who have visited our website, and track conversions from our social media ads. Opting Out of Tracking

11. Indemnification

You agree to indemnify, defend, and hold harmless Port A Vacation Company, its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to your use of our services, violation of these Terms, or infringement of any third-party rights.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, hurricanes, tropical storms, government actions, pandemics, utility failures, or other acts of God. In such events, we will make reasonable efforts to notify you promptly and offer alternative arrangements or a refund where applicable.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Nueces County, Texas. You consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of our website and services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
